You also agree to comply with all applicable laws and regulations, including applicable taxes, exports and re-exports control regulations. Shipping Rates

Shipping rates are estimated based on the best information available at the time and are out of our control.  Certain remote or unserviced areas may be subject to additional charges unforeseen at time of order.  We don't ship via Canada Post.  You will be notified if shipping rate cannot be honored ahead of time.  Additional charges may apply for Non Boxed ($11)  and oversized items ($50).  We reserve the right to change carriers or refuse orders do to delivery issues. If shipping address is incorrect and has to be changed, a $13 service may be applicable.  Special instructions cannot be forwarded to delivery driver. 


Refund / Return Policy

All returned goods will not be accepted without prior written authorization. Upon inspection and approval of returned items, the terms of credit are as follows:


  1. Cerka will accept return of goods that are defective, or shipped in error for full credit.
  2. Returns accepted within 30 days of purchase.
  3. Returned goods accepted by Cerka MAY be subject to a minimum 20% handling charge.  This applies to items not normally stocked , specially ordered (ie. Availability: Call), mounted tires & wheels or labour intensive orders.
  4. Cerka will not accept return of any merchandise, which is specially fabricated in any way.
  5. All returns must be freight prepaid, goods sent freight collect will have freight charged back to their account.
  6. A copy of the invoice MUST accompany the return goods.

 

Order Cancellation Policy

Order cancellation requests may be subject to a 20% charge if the orders have been picked and packaged.  If the order has already shipped please refer to the Return Policy above. Specially manufactured items (ie. Custom Axles) cannot be cancelled once manufacturing has begun.

 

Pricing

Cerka Industries reserves the right to correct pricing errors.  Although we strive to maintain it's accuracy and timeliness, occasional errors in pricing may occur.  The price on Out of Stock or back ordered items cannot be guaranteed as price changes are updated based upon new product arrival costs.  Any price changes will be communicated to the customer before charging the customer.


Claims

Claims for lost or damaged goods should be placed with the carrier. Cerka IS NOT RESPONSIBLE for merchandise lost/damaged in transit. Our responsibility ends when goods have been consigned and accepted by a carrier. All claims for any shortage or error in the order must be fully detailed and presented in writing within ten days after receipt of shipment.

 

Limitation of Liability

IN NO EVENT SHALL THE STORE OWNERS, ITS PARENT, SUBSIDIARIES, OR AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, OR AGENTS BE LIABLE FOR DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE, OR INDIRECT DAMAGES (INCLUDING BUT NOT LIMITED TO, LOSS OF DATA, USE, OR PROFITS), HOWEVER CAUSED, WHETHER FOR BREACH OF CONTRACT, NEGLIGENCE, OR OTHERWISE, AND WHETHER OR NOT THIS COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES. YOU AGREE THAT THE COMPANY PARTIES MAXIMUM LIABILITY ARISING FROM ANY PRODUCT SOLD SHALL NOT EXCEED THE PRICE OF SUCH PRODUCT. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU TO THE EXTENT SUCH JURISDICTIONS LAW IS APPLICABLE TO THIS AGREEMENT.
